As an Event Organizer, you undertake to comply with applicable law and to notify Sellers and obtain their consent for collection, use and further sharing of their personal data by you through your own privacy policy and terms and conditions;
As a Seller, you undertake to comply with applicable law and to notify Buyers and obtain their consent for collection, use and further sharing of their personal data by you through your own privacy policy and terms and conditions.

If you are under the age of 18, you may not use the Popupular Platform and Services. Please note that we do not verify a user's age and are not liable for any under-age usage of our Platform or Services. As a Event Organizer or Seller, you are solely responsible for verifying the age of any users you engage with on the Popupular Platform. You are also responsible for any and all account activity conducted by a minor on your account. If you believe we might have any information from or about a minor, please contact us at info@popupular.in. We will take appropriate steps to delete information and accounts of users under the age of 18.

2. Information We Collect

We collect several types of information from and about users of our Services:

Account Information: When you create an Account, we collect some personal information, such as your name, email address, and phone number.
Information about your Business: We collect all information that you provide to us about your business, including but not limited to business name, details of individuals associated with your business, name and address of your business, email address, phone number, social media handles, bank account and other relevant financial information, and copies of government issued identification.
Usage Data: When you use the Services, we collect information about your activity, such as the features you use, the pages you visit, and the searches you perform.
Device Information: We collect information about the device you use to access the Services, such as the device type, operating system, IP address, and browser type.

3. How We Use Your Personal Information

We use the information we collect to:

Provide and improve the Services. Amongst others, we use your personal information to assist Event Organizers and Sellers in all relevant aspects related to organizing, managing and analyzing Popup events, as well as processing related customer orders and financial transactions.
Send you important information about the Services, including updates, announcements, and promotional offers.
Respond to your inquiries and support requests, as well as assist in troubleshooting any problems.
Customize and otherwise enhance your experience with the Services.
Measure customer interest in our products and services; conduct marketing research, analysis and surveys; and as otherwise described to you at the time of collection of information.
Detect and protect us against error, fraud and other criminal activity; enforce our terms and conditions; and comply with legal and regulatory requirements.

4. Sharing of Your Personal Information

We may share your information in the following ways:

If you are an Event Organizer, we will share your personal information with the participating brands. We will not share personal information about the Sellers participating in an Event organized by you with any other Event Organizer.
If you are a Seller, we will share your personal information with the Event Organizer, but not with any other Seller.
We may also share your information with third-party service providers who help us operate and improve the Services. These service providers are contractually obligated to keep your information confidential and secure.

We will not share your information with any other third party without your consent, except as necessary for us to comply with our legal obligations, to enforce our user agreement, to facilitate our marketing and advertising activities, and to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our services.

5. Your Choices

You have choices regarding your information:

You may review, correct, update, and change the information that you have provided to us at any time.
You can opt out of receiving marketing emails from us.
You can request that we delete your information.

6. Links to Third Party Websites/Apps

The Popupular Platform and Services may contain links to other websites and applications. Any Personal Data about you collected when accessing such third party websites or apps is not governed by this Policy. We are not responsible for, and have no control over, the privacy policies, practices and content of any external website or app which may be linked from the Popupular Platform or Services. You further acknowledge and agree that we are not liable for any loss or damage which may be incurred by you as a result of the collection and/or disclosure of your information by any third party and their websites or apps.

7. Data Security Precautions

To protect your personal information from unauthorized access or disclosure, loss or misuse we adopt reasonable security practices and procedures. Please be aware, however, that the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted through the Popupular Platform or in connection with our Services. If you suspect any unauthorized use of your account, you must immediately notify us by sending an email to info@popupular.in. You shall be liable to indemnify us for any loss suffered by us arising from any unauthorized use of your account or password. We shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond our reasonable control.

We may occasionally update and modify this Policy without prior notice and any such changes will be effective immediately upon being posted on this page. To the extent permitted under applicable law, your continued use of the Popupular Platform or Services after we publish changes to this Policy shall constitute your consent to the updated Policy.

9. Miscellaneous

Disclaimer: Although we will undertake utmost care to protect your privacy, we cannot ensure and do not promise that your information or private communications will always remain private. While using the Services, you understand and agree that you assume all responsibility and risk for your use of the Services, and Internet generally, and the information you post or access.
Indemnity: You agree and undertake to indemnify us in any suit or dispute by any third party arising out of disclosure of information by you to third parties either through our Popupular Platform or otherwise and your use and access of websites, applications and resources of third parties.
Limitation of Liability: Popupular shall not be liable for any consequential, incidental, special, indirect, exemplary or punitive damages, or damages for any loss of profits, revenue or business, regardless of the nature of the claim, even if Popupular has been notified of the possibility of such damages.
Severability: Each clause of this Policy shall be and remain separate from and independent of and severable from all and any other clauses herein, except where otherwise expressly indicated or indicated by the context of the Policy. The decision or declaration that one or more clauses are null and void shall have no effect on remaining clauses of this Policy.
